The article also states Fortune is under investigation by the Attorneys General of Texas, Kentucky, North Dakota, and North Carolina with Missouri, South Carolina, Illinois, and Florida following up complaints against the company. In 2013, the FTC's court-appointed receiver determined that Fortune was nothing but an illegal recruitment MLM and that least 88 % of the members did not even recoup their enrollment fees and that more then 98% had lost more money then they ever made.[54][55] Refund checks mailed out totaled over $3.7 million.[56]

MLMs are designed to make profit for the owners/shareholders of the company, and a few individual participants at the top levels of the MLM pyramid of participants. According to the U.S. Federal Trade Commission (FTC), some MLM companies already constitute illegal pyramid schemes even by the narrower existing legislation, exploiting members of the organization.[21] There have been calls in various countries to broaden existing anti-pyramid scheme legislation to include MLMs, or to enact specific anti-MLM legislation to make all MLMs illegal in parallel to pyramid schemes, as has already been done in some jurisdictions.[citation needed]

When I came across the Nutiva Organic Hemp Oil it was so much less I started checking to find out what the difference was. I read the reviews and everyone was saying how much it helped. Thank God a book like this exists. After participating in a very popular "ground floor" MLM, my eyes have been opened to the brainwashing that goes on and the history behind these MLM pyramid schemes. There were way too many ethical issues for me to proceed with this business even though I think it's a good skincare product. The gist of the matter is that the courts have found that as long as an MLM can show that its primary purpose is to sell product (even to people within the MLM) and not recruitment of distributors, the company is considered a legitimate business and not a pyramid scheme. But this line is really fuzzy, and little to no effort is made by law enforcement agencies to make companies prove that they emphasize retail over recruitment.
